Canberra lawyer Rachel Bird has called it quits on what was to be the sentencing date for a man police allege to be a former bikie.
Ms Bird of Rachel Bird & Co applied to withdraw from representing alleged former Rebel’s member Ryan Lee Marshall, 26, when the matter was heard in the ACT Magistrates court on Tuesday
Marshall was due to be sentenced for 15 charges; eight counts of posing a declared substance, three counts of possessing or using a prohibited weapon, being in possession of the proceeds of crime, possessing/ selling or supplying a drug or dependence, possessing a drug of dependence and possessing a knife without reasonable excuse.
Magistrate Robert Cook granted Ms Bird’s application to withdraw from the case.
After Ms Bird left the courtroom, Mr Cook expressed his frustration about the situation.
“This case has run since February 1 (there was a) pre hearing mention on May 4,” he said.
“(It’s been) over two months.”
Mr Cook said despite the fact the matters were due to be sentenced, he said the matter would need to be adjourned so Marshall could seek legal advice from ACT Legal Aid.
He told the 26-year-old thorough representation was necessary because he was facing 15 “serious” charges that could lead to imprisonment.
Marshall told the court Ms Bird told him on Friday that she would not appear for him because he was unable to pay a $2000 legal fee.
“Everything is going for you but then you do all of this,” Mr Cook remarked.
Sam McLaughlin from ACT Legal Aid appeared on behalf of Marshall and asked for an adjournment so he could get across the case.
Mr Cook adjourned the case and listed it for mention on July 27.
