Riverstone rape accused Josateki Kaboa Setuata seeks curfew shift

One of three men accused of raping a woman at a western Sydney house has asked to scrap his curfew so he can travel into regional NSW. Here’s what happened in court.

A judge has adjusted bail conditions to allow Josateki Kaboa Setuata, who is one of three men accused of raping a woman at a house in Riverstone on Anzac Day last year, to work in regional areas outside Sydney.

Mr Setuata, Glenn Kenneth Robinson and Joe Tauiliili have pleaded not guilty following an alleged incident after a drinking session at The Fiddler at Rouse Hill.

A court heard previously the alleged victim had been drinking with Robinson at The Fiddler in Rouse Hill before she was invited back to a Riverstone house where the alleged incident took place.

Mr Setuata, 27, is fighting a charge of sexual intercourse without consent and Mr Robinson, of Warrimoo in the Blue Mountains, pleaded not guilty in March to aggravated sexual assault in company with other person and four counts of sexual intercourse without consent.

Mr Tauiliili pleaded not guilty to two counts of aggravated sex assault in company, principal in second degree to serious indictable offence of aggravated sex assault in company and sexual intercourse without consent.

At Parramatta District Court on Tuesday, Mr Setuata’s lawyer applied to adjust his client’s reporting conditions to police.

The court heard how Mr Setuata’s work with civil construction company Terracon Civil takes him to regional areas such as Wollongong and Newcastle, meaning he would not return to Sydney in time for the 10pm curfew if he completed work at 8.30pm.

Under some of his existing bail conditions, Mr Setuata must report to Riverstone police station on Monday, Wednesday and Friday between 6am and 10pm.

He must not be absent from the Riverstone premises between those hours unless there is a medical emergency for him or his partner.

Judge Mark Buscombe suspended the curfew bail condition, allowing Mr Setuata to work outside the Sydney metropolitan area.

He must provide the police officer in charge written notice 24 hours before he starts work outside Sydney.

Mr Setuata and the two co-accused men are listed for callover on January 27 and a two-week trial is scheduled from April 24.
