THE bid by the wife of a slain former Comanchero bikie boss to use his sperm post-mortem may be hindered because Mahmoud “Mick” Hawi didn’t make a will before being gunned down.

SLAIN former Comanchero bikie boss Mahmoud “Mick” Hawi may was gunned down before he made a last will and testament, a court has heard.

Despite having numerous enemies the NSW Supreme Court heard Hawi’s widow Carolina Gonzales is not sure whether her husband, who was brazenly ­assassinated outside a gym in Sydney’s south, ever had a will.

Last week Ms Gonzales successfully applied in court to gain access to her husband’s body so she could salvage sperm to be kept on ice for future IVF use.

Barrister Evan James told the court on Friday his client needed time to find the will, if there was one, and speak to relatives before they made a formal submission.

“There is a degree of confusion about whether Hawi had a will or where that will is,” Mr Evans told the court.

“If it would assist the court we would like to at least take some preliminary steps towards using the sample and put those steps in place where necessary but nothing of course will be done without the court’s permission.

“We also need some time gather affidavits from surviving relatives and family of the deceased in the event they need to be supplied to support our submission.”

Nine tubes or straws of sperm taken from her late husband are currently be stored at a medical facility.

The urgent application to retrieve the samples was lodged in court 24 hours after Hawi’s death on February 15 and was conducted at the city morgue where his body was being held.

The 37-year-old former bikie was jailed in 2012 for his role in the infamous Sydney Airport brawl in which his gang stabbed and bludgeoned rival bikie Anthony Zervas to death in the domestic departures hall.

Hawi was originally found guilty of murder for his part in the airport brawl, but his conviction was overturned on appeal and he plead guilty to the lesser charge of manslaughter.

After he was riddled with bullets outside the Fitness First gym in Rockdale he was rushed to St Georges Hospital and placed on life support but a few hours later he died.

It is believed Hawi suffered multiple heart attacks after being shot and police believe the black-clad gunmen fled in a grey Mercedes station wagon, possibly with the help of a getaway driver, and burnt it out in the neighbouring suburb of Kogarah.

Family and friends of Hawi gathered at a southern Sydney mosque in the suburb of Arncliffe on February 22 to farewell the murdered bikie.

His unidentified killers remain on the run amid warnings, from police and Hawi’s associates alike, that they will be unmasked.
