SPERM extracted from the body of murdered former bikie boss Mahmoud “Mick” Hawi is being stored at an IVF facility until a court rules on his widow’s pending application to use it, a Sydney judge has been told.

Former Comanchero Motorcycle Club president Mahmoud “Mick” Hawi was gunned down outside a Rockdale gym in Sydney’s south last month.

No one has been arrested over the crime.

The court allowed the retrieval after Ms Gonzales’ legal team filed an affidavit from urologist Dr Derek Lok on February 16, which stated any post-mortem sperm retrieval procedure needed to be undertaken as soon as possible after death and it needed to be done within 36 hours after death.

Ms Gonzales’ Barrister Evan James told the court this morning the procedure was successful completed.

“Nine tubes or straws, as I have been told they are called” were taken from Hawi and are currently being stored at an IVF facility,” said.

The matter will return to court on Thursday as the wife of the slain bikie boss now fights for the ability to use the sperm to have more children via IVF.

Justice Peter Johnson adjourned the matter requesting clear and certain information be provided about what had happened.

“By midday Wednesday an affidavit must be filed to the court outlining precisely what was done with the sample once it was obtained and where it is being stored under what conditions it is being stored,” Justice Johnson said.

“I want an affidavit from Dr Lok detailing what was done so the court has a clear and certain understanding of the position of the plaintiff.”

Hawi married his high school girlfriend in 2002 and although they already have two sons together, Justice Johnson noted that Ms Gonzales “desired, and still desires, to have a child from the deceased in the near future”.

Ms Gonzales, made an “urgent application” to the NSW Supreme Court a day after Hawi was gunned down outside the Fitness First gym in Rockdale on February 15.

The affidavit states Ms Gonzales “still desires” to have a child to her dead husband in the “near future” and thus wants a post-mortem sperm retrieval to be carried out.

As national president of the Comanchero motorcycle club, Hawi was imprisoned over the bashing death of Hell’s Angels associate Anthony Zervas in a wild brawl at Sydney Airport in 2009.

Since his release in 2015, he laid low in south Sydney.

But Hawi’s suburban life came to an end when he was shot multiple times while he sat in his luxury Mercedes 4WD outside Rockdale’s Fitness First. He died in St George Hospital that night, aged 37.

Police are still hunting for Hawi’s killers.
