A man charged with brutally murdering his partner after her battered body was found in a North Coast laneway more than a year ago remains in custody on remand as his case crawls through the courts.
Robert Karl Huber, 67, was excused from appearing during a mention of his case before Magistrate Michael Dakin in Lismore Local Court on Wednesday.
It was alleged by police in the court Huber contravened an apprehended violence order by repeatedly punching Lindy ‘Kimmy’ Lucena in the face weeks before her death, breaching bail.
Huber was released from custody a day before Ms Lucena’s death, police state in court documents.
Ms Lucena’s badly beaten body was found by Ballina police on Holden Lane, near Cherry St, on January 4 last year.
Found half naked and bloodied with heavy bruising and a horrific head injury, Ms Lucena’s passing was the first alleged domestic violence death of 2023.
The 64-year-old was found after Huber, 66, went into Ballina Police Station to speak to officers.
A candlelight vigil was held at Ballina soon after her death, attended by Mayor Sharon Cadwallader, who described the situation as a “tragedy”.
Huber and Ms Lucena were victims of the 2022 floods and began dating in 2018.
They lived at Reflections Caravan Park at the time of the alleged murder.
Huber was Ms Lucena’s carer and a cleaner at the Ramada Hotel in the coastal town.
Legal Aid lawyer Katharine Brady told the court on Wednesday an adjournment was needed to allow for the completion of a forensic psychology report.
Huber is due to appear over videolink in the court for an Early Appropriate Guilty Plea conference mention on July 10.
He has not yet entered pleas to any charges.
