A man who allegedly broke into a Casino house with two others – with a resident allegedly assaulted with a tomahawk for “running his mouth off” – wants to get out from behind bars.
Tyrese Tighe, from Casino, faced Lismore Local Court via videolink on Wednesday where he made a bail application.
The 21-year-old is charged with aggravated break and enter and committing a serious indictable offence, while people were home, and failing to appear in court. He has not entered pleas.
Court documents state Tighe was living at the Casino Motor Inn when he and two co-accused allegedly broke into a Hickey St home about 8.30pm on January 21.
Police state Tighe allegedly stole from the house, knowing a woman and two men were home.
Magistrate Philip Stewart told the court Tighe was allegedly carrying an axe when one of the co-accused assaulted a resident with the tomahawk.
Mr Stewart said text messages on Tighe’s phone stated the alleged victim had been “running his mouth off”.
The court heard Tighe was initially granted bail, but failed to appear in court in September when a warrant was issued for his arrest.
Tighe’s lawyer Isabel Attwooll said her client could provide a suitable address if he was granted bail.
She said the offender had “very naively” relocated to Queensland without telling anyone, however handed himself into police when he found out he was wanted.
She told the court Tighe was an Aboriginal man, it was his first time in custody and he would not be a significant risk to the community.
Police prosecutor Virginia Szaak opposed the bail application and said he had previously failed to appear at court and would be a risk to the community if released.
“The owner of the proposed address did not clearly state Tighe was allowed to live at the house,” she said.
Tighe crossed his tattooed arms across his chest as Mr Stewart refused bail.
Mr Stewart said while Tighe had a limited criminal record, he would pose a risk to the community if he was released. The case has been adjourned to February 12.
