Payton Jane Lousie Duncan convicted at Casino court of driving while disqualified

A late night random police stop ended badly for a young driver when officers asked to see her licence. See why the court took a dim view of the matter.

A disqualified L-plater from Casino was busted driving less than two months after her licence was suspended.

Payton Jane Louise Duncan, 21, appeared at Casino Local Court on Friday October 7 charged with driving a car on the road while disqualified – second offence.

Police stopped a car travelling south on Centre Street, Casino for random testing, at about 9.50pm on August 24.

When officers asked for Duncan’s licence, she immediately told them she did not have one and believed she was suspended.

A roadside breath test returned a negative result.

But checks by police revealed the accused had a learner’s licence that had been suspended from July 8, 2022 to October 8, 2022.

Duncan’s solicitor said his client had not been driving in a reckless manner that would have alerted police.

But magistrate Michael Dakin said it was still concerning that Duncan was driving so soon after she had been disqualified.

Duncan was convicted and sentenced to an 18-month community release order, and disqualified from holding a driver’s licence for eight months.

Mr Dakin warned her “don’t drive” until she was legally able to do so.
