A Kyogle man convicted of rape has also been found guilty to offering to supply a prohibited drug related to the horrific crime.
Gregory James Agnew, 40, was found guilty and convicted of two charges of sexual intercourse without consent during a Lismore District Court trial in June.
The matters relate to a November 2018 incident, and he was later arrested in May 2020 after a five-month police investigation into several alleged drug and sexual assault incidents within the Richmond Police District.
However, matters handed up on a 166 certificate following that trial included a supplying drugs charge that defence barrister Megan Cusack said was “intrinsically linked” to the case.
The matter was dealt with in Lismore District Court on Friday, June 5 where Judge Jeffrey McLennan told the court the man had offered “cocaine” to the victim.
“He asked whether she wanted some cocaine, she said she didn’t but he was very persistent,” Judge McLennan said.
“In the end she did so.”
The court heard the two snorted the two lines of the drug and then as the drug was “kicking in” and the victim began to fade out and “feel blurry” the man began to rape the victim.
Upon deliberation, Judge Jeffrey McLennan ruled Agnew was guilty of offering to supply a prohibited drug.
He, however, dismissed the Crown’s alternative charge of supplying a prohibited drug.
“The accused’s assertion is based only what others have told him,” he said.
“In short, his assertion he gave the complainant cocaine can only be a hearsay.”
A sentence date for the two counts of sexual intercourse without consent is listed for August 26.
