Kristopher John Shaw, 33, on trial in Lismore accused of raping woman during Byron Shire ‘magic mushroom’ trip

A Victorian man has denied raping a woman and told a court “we had a great time” after they drank “magic mushroom” tea at a Byron Shire pub, watched cartoons and played with his pet goat.

A Victorian man has denied raping a woman and told a court “we had a great time” after they drank psilocybin “magic mushroom” tea at a Byron Shire pub, watched cartoons and played with his pet goat.

Kristopher John Shaw from the Macedon Ranges is on trial in Lismore District Court. The 33-year-old has pleaded not guilty to sexual intercourse without consent.

Shaw took to the stand and denied he anally raped the woman while they were “tripping” on the psychedelic drug on December 5, 2021.

Shaw told the court he and the woman watched the TV show Rick and Morty and played with his goat named Little Stefan, resulting in “hysterical” laughter.

Crown prosecutor Kate Biffin said on Friday that Shaw lived in the Byron Shire at the time and began having casual sex with the alleged victim.

The complainant and Shaw visited Billinudgel Hotel and drank the tea before they went to Shaw’s home.

It is disputed in the trial whether the pair had oral sex before returning to the pub.

Ms Biffin alleged Shaw was forceful with the complainant’s head during oral sex, which caused her to have “difficulty breathing”.

The pair went back to the pub and danced with its owners while the venue was closed, the court heard.

Ms Biffin said the pair went back to Shaw’s home and the woman told him she did not want to have sex because she was on her period.

It’s alleged Shaw suggested anal sex, the woman said she did not want to and he anally raped her.

Ms Biffin alleged the woman elbowed Shaw away and he began crying and apologising.

Pub owner Kirsten Ednie was called to give evidence and said the alleged victim told her the next day that Shaw “forcefully had anal sex with her”.

“She told me sitting down was painful for her,” Ms Ednie told the court

The complainant reported the alleged sexual assault to police in June 2022.

A recording of Shaw being interviewed by police was played in the court.

He told investigators the complainant worked as a masseuse, he was a client and they had sex twice before.

Shaw told Ms Biffin the alleged victim came to his house once on the night, but they did not have sex.

“We tripped on magic mushrooms, we had a great time,” he said.

Shaw said he was “almost positive” he went home alone.

He told the court he had been seeing the woman for massages as a client, but had to cancel an appointment and bought her a drink to make up for “mucking her around”.

Ms Biffin said Shaw made up a story to make it seem like he was on “friendly terms” with his accuser.

Shaw denied that suggestion, but said it was difficult to remember exactly what he said.

Ms Biffin argued Shaw said the woman did not return to his home a second time to “distance” himself from allegations, which he denied.

Defence barrister Megan Cusack again argued the woman did not return to Shaw’s home on the night.

She told the court the alleged victim was not “angry” or “stand-offish” towards Shaw after that night. Ms Cusack also said Shaw did not have any criminal record.
