Liam Wolhar: South Grafton man jailed after Subway sandwich assault at Grafton Shopping World

A North Coast dad was visibly shocked to learn he would be jailed after he hurled a Subway sandwich at a man who he threatened and labelled a “pedo” at a shopping centre.

A young father was shocked to learn he would be sent to jail for threatening to kill a stranger, calling the man a “pedo” and throwing a Subway sandwich at his face.

South Grafton man Liam Wolhar, 22, was sentenced to more than half a year behind bars when Magistrate Roger Prowse sentenced him at Grafton Local Court on Monday.

The 22-year-old pleaded guilty to common assault and intimidation.

Wolhar appeared shocked and emotional as he was taken into custody.

At the time of the offences, Wolhar was on a good behaviour bond because he previously threatened the father of his brother, making allegations against him and stating “I’ll bash you”, according to court documents.

Wolhar was also previously convicted for driving with illegal drugs in his system and driving disqualified.

Wolhar once again found himself in hot water when he visited Grafton Shopping World on the morning of October 6.

The young dad spotted a man who was not known to him near the Healthy Habits store.

Wolhar yelled out “pedo, pedo”, falsely alleging the man was a pedophile, the documents state.

When the man approached security, Wolhar walked behind him and hurled a Subway sandwich, hitting him in the face.

Security escorted Wolhar out as he shouted “I’m going to kill you”, police state in the documents.

Wolhar continued to make threats, including “I’m going to flog the motherf--ker”, “I will put a knife in”, “I see that c--t, blood out here” and “You can pick his f--king body off the ground”.

When the 22-year-old was arrested, he said: “Yeah I threw the sub at him.”

“I thought it was better than a punch to the face,” Wolhar said.

It was not made clear to the court whether the projectile was a foot-long or six-inch sandwich.

Defence lawyer said Wolhar made the “vile comments” when he was on conditional liberty.

She said Wolhar had a difficult childhood and left home when he was just 14.

The defence lawyer argued for a community-based sentence and told the court Wolhar had a strong social network and cared for his young daughter.

But Mr Prowse said the threshold for a term of imprisonment had been “obliterated as opposed to crossed”.

He said Wolhar “hurled a sub” and threatened to stab the stranger to death.

Mr Prowse said there was “no other purpose than to denigrate and humiliate” and Wolhar made “a vile assertion”.

“It was not a rock … but nor was it a feather or a marshmallow,” he said of the sandwich.

“(The) intimidation would have caused anybody that lives … to be fearful that you would carry out the threats.”

Wolhar was convicted and sentenced to 14 months jail, with a seven-month non-parole period.

Mr Prowse said Wolhar showed other sentencing options “do not have any impact”.

An appeal against the severity of the sentence has been lodged.
