Nadia Jo Toffetti pleads guilty at Byron Bay Local Court to possessing cocaine

A Potts Point Sydney woman has been busted for cocaine possession after a police patrol spotted her in downtown Byron Bay next to a man lying prone on the footpath.

A Sydney woman busted for cocaine possession in Byron Bay had been trying to help an unresponsive man with white powder around his nostrils.

Nadia Jo Toffetti, of Potts Point, pleaded guilty at Byron Bay Local Court on Monday to possessing cocaine.

Police were patrolling Jonson St when they came across the 24-year-old who was with a man unconscious on the footpath about 9.15pm on September 28, police facts state.

Toffetti told officers the man had too many alcoholic drinks.

“Police could see a clear resealable bag sticking out the man’s pocket and saw Toffetti push it further into his pants once police noticed it,” court documents state.

The bag contained a small amount of cannabis.

Police noticed white powder around the man’s nostrils, and when he became conscious, the pair denied taking cocaine.

Officers searched the man then asked to inspect Toffetti’s handbag.

“She initially refused before handing over the handbag where police located 0.70g of cocaine,” court documents state.

Toffetti confirmed it was cocaine for personal use and she had taken some already.

Police confiscated the drug and Toffetti was given a court attendance notice.

In court, defence lawyer Sally McPherson said her client had been attempting to help the unconscious man.

“She entered early pleas of guilty and uses drugs to help cope with the passing of her father,” Ms McPherson said.

“Toffetti is from Sydney and spent money to come to Byron Bay Local Court to have the matter finalised.

“She is undergoing drug treatment.”

Magistrate Kathy Crittenden said Toffetti had a previous cocaine charge on her criminal record.

“The drug is illegal in this country,” she said.

Ms Crittenden convicted and fined Toffetti $200.
