Mr Goldsmith was accused of assaulting a boy he believed had been using golf clubs to hit rocks at cars on The Strand at New Brighton, a short drive from northern NSW tourism hub Byron, about 12.30pm on August 2.

He strenuously denied the charge laid by Tweed/Byron Police District.

On Monday, the allegation was dismissed in Byron Bay Local Court, after Mr Goldsmith engaged top lawyers to defend the case.

Father-of-one Mr Goldsmith said he was acting as a concerned citizen after the vehicle of a local female cleaner was damaged by one of four teens aged between 13-14.

The left side of the woman’s vehicle was allegedly damaged when it was struck by a rock as she was driving to clean Mr Goldsmith’s house.

She subsequently made a statement to police and several weeks later, one of the boys’ parents reported Mr Goldsmith had grabbed their son by his T-shirt and insisted he sit on the ground as he confiscated the golf clubs.

It was alleged the boys were hitting rocks at cars.
It was alleged the boys were hitting rocks at cars.

“The victim and his friends were all young persons of the age of 13 – 14 years old, while walking along the street the boys have discovered some old discarded broken golf clubs before hitting various rocks, sticks and other items located along the ground whilst continuing walking along the same route,” a police statement of facts read.

“One of the victim’s friends in the group has hit a small rock on the ground which accidentally hit and damaged a car that was driving past.”

Defence lawyer Alex Cao of Brightstone Legal appeared on Mr Goldsmith‘s behalf in the court.

“This was our first appearance in court regarding this matter and gratefully, the defence‘s representations have been reviewed and accepted by the chain of command,” he said.

“The charges against my client were rightfully withdrawn.”

Mr Goldsmith is well known in celebrity circles and has assisted big names – world champion surfer Kelly Slater said he helped him relax during stressful times.

“Charlie is one of the most aware and kind people I know. I could never imagine him even raising his voice at anyone unless someone’s safety was at risk,” he said.

“Hearing recent allegations towards him was frustrating to say the least because I know “Charlie wants the best for everyone and is committed to that in his life.”

Mya Atkins said her vehicle was the one damaged.

“I am so thankful to Charlie for helping me, if it wasn’t for him the damage wouldn’t have been paid for and I couldn’t afford to fix it myself,” she said.

“I’m sorry for what he’s been through all because he helped me and protected others.”

Several other local residents offered testimonials to support Mr Goldsmith’s version of events.

“It is outrageous that these boys using golf clubs hit a moving car with a rock and it was deemed acceptable, whilst Charlie doing the right thing intervening was criminally charged,” former Richmond AFL captain Kane Johnson said.

“Fortunately, the police rightfully dismissed the charges.”

Phil Lee, former Brisbane Broncos player, said he saw the damaged car.

“It is a miracle no one was killed,” the resident said.

“Charlie helped our teenage son last year and didn’t ask for anything in return, it’s shocking to hear what they’ve put him through.”
