Luke Anthony Fuller in court for allegedly breaching bail

A 37-year-old Byron Bay man has been remanded in custody after facing the Gympie Magistrates Court. Read what happened here:

An aspiring rapper from Byron Bay was remanded in custody to Gympie Magistrates Court on Monday, charged with breaching his probation.

Luke Anthony Fuller, 37, did not apply for bail nor enter a plea.

Mr Fuller was charged with breaching his probation by leaving Queensland without the permission of Queensland Corrective Services on September 29, 2021.

He was placed on probation by the Cleveland Magistrates Court on March 9, 2021, after he was convicted of six offences, including drink driving and failing to appear.

Gympie Magistrates Court heard Mr Fuller went to Victoria with no intention of returning to Queensland, though Mr Fuller denied this in court.

“I haven’t been to Victoria,” he said.

Magistrate Chris Callaghan asked Mr Fuller if he intended to plead guilty or not guilty to the allegation, but Mr Fuller looked at his lawyer and said “guilty?” with a confused tone.

Mr Callaghan did not accept this, and adjourned the court for Mr Fuller to discuss the matter with his lawyer.

But when court returned, the confusion continued.

Defence lawyer Chris Anderson said his discussion with Mr Fuller did not clarify whether his client wanted to plead guilty or not guilty, and that his answers were “inconsistent” with what was discussed earlier in the day.

Mr Callaghan suggested Mr Fuller be assessed as to whether he would be fit to enter a plea, which would mean a lengthy remand in custody.

Mr Fuller asked if he could be transferred to the Cleveland Magistrates Court where he could get medicine for a brain tumour.

“Why can’t you get your medicine in Gympie?” Mr Callaghan asked.

At this point, Mr Fuller’s partner and only supporter in the public gallery addressed the court.

She said they were travelling through Gympie to visit family, and were intending to visit Mr Fuller’s family in Southport, where his “medication” would also be.

“We were literally on our way out of Gympie, and we saw someone following us...and there was a random breath test and we stood around for five and 10 minutes and they told us that he had to come to the police station,” she said.

Eventually, the court came to an agreement that Mr Fuller be remanded in custody and transferred to the Cleveland Magistrates Court, as he requested.

He will reappear in Cleveland on February 17.
