A man who served less than seven years jail for bashing a four-year-old boy to death is back on remand, accused of rape just three months after his release.

The killer, whose name is suppressed, was described at his trial as “a ticking time bomb” after he injected speed and attacked his girlfriend’s son in 2011.

He was sentenced to a maximum eight years for manslaughter, with a non-parole period of six years.

But after being released in December last year, the man was charged with two counts of raping a woman at two NSW locations in March. He is set to face trial in July.

NSW Corrections minister David Elliott is now demanding a “please explain” from the State Parole Authority after victims’ groups raised questions about monitoring of the man.

The decision to parole the offender after six years and seven months, despite opposition from NSW Corrective Services Commissioner Peter Severin, is a headache for the state government which is already on the back foot over the issue of dangerous offenders being freed only to reoffend.

It follows outrage at the arrest of Anthony Sampieri, accused of attempting to rape a seven-year-old girl in the toilets of a Kogarah dance studio last month after being released on parole last year.

That incident prompted Mr Elliott to order both police and parole board reviews.

Victims’ advocate Howard Brown said: “This is Sampieri all over again. There needs to be an overhaul of risk assessment because clearly the current system is failing.

“If you can’t be convinced that prisoners have been rehabilitated to a standard that ensures the safety of the community, then they should not be let out. It’s that simple.”

A spokeswoman for Mr Elliott said yesterday: “The minister will be seeking further information about the circumstances around the man being given parole.”

The boy’s killer was sentenced in 2013 after controversially being allowed to plead guilty to manslaughter despite originally being charged with murder.

The sentence included a balance term of two years, meaning if he was released early and re-offended, he would be ordered to serve the remainder of the sentence.

When charged, he had one year, one month and 26 days left on his sentence.
