Deng Bol Biar in Ballina court on domestic violence assault charge

A woman scaled an excavator at Lennox Heads in a bid to escape her partner - who, after appearing at Ballina court, has been told he must live in Queensland.

Deng Bol Biar, 39, of Rockville, Queensland, pleaded guilty at Ballina Local Court on October 20 to common assault domestic violence related and contravene prohibition/restriction apprehended violence order (domestic and personal violence).

Court documents revealed that Biar had been served with a nationally recognised Queensland domestic and family violence protection order on July 7, 2022, in Toowoomba.

As part of that order Biar is to behave well in the presence of his partner and not have a blood-alcohol concentration exceeding 0.05 per cent while in the presence of the aggrieved.

He must also submit to a police breath test when asked.

Police facts state Biar and his partner got into an argument over his intoxication level on September 30, and officers were called to a roadworks site at Ballina Street, Lennox Head, around 12.50pm to reports of a domestic incident.

Biar followed his partner after she attempted to remove herself from the situation, according to court documents, as he yelled at her and slapped her face.

The woman climbed a nearby excavator and called for help.

Biar pulled her from the machine and threw her against it, police facts state, before punching and slapping her.

The woman escaped and Biar ran after her. When he caught her, she threw her mobile phone to embers of the public nearby who had been drawn to the area by the commotion.

Bystanders were able to separate the pair and, according to court documents, when police arrived they found Biar sitting in his vehicle.

Biar told them he had consumed a few drinks - and he was arrested after police located an empty bottle of whisky in his car. Police also found the woman’s phone in his pocket.

At Ballina court, Magistrate Karen Stafford accepted an application for an apprehended domestic violence order in NSW against Biar for a period of two years.

Sentencing was adjourned to January 20, 2023, due to a request for a sentencing assessment report from Lismore community corrections district office.

“The maximum penalty for breaching an AVO is two years in jail,” Ms Stafford said.

Biar’s bail was continued from his application on October 1 with additional conditions that he live at Rockville Qld, not drink alcohol or take drugs unless those drugs are prescribed by a doctor, and strictly comply with the nationally recognised protection order made on July 7, 2022, at Toowoomba.
