A repeat domestic violence offender who callously bashed his partner at a North Coast car wash for almost half an hour has been slammed by a magistrate for “one of the most sustained DV assaults” she has seen.
Bradley Scott Presbury was previously convicted of the manslaughter of Iluka man Aaron Marks.
The 28-year-old’s partner was found by police at Evans Head with blood seeping from a head wound after his latest violent act, Ballina Local Court heard.
Magistrate Karen Stafford said there were 23 assaults during the time frame of offending.
“She was clearly frightened out of her wits,” she said.
“It’s almost like you weren’t treating her like a living human being …
“You dehumanised this woman and petrified her to the point she couldn’t even tell police what you were doing to her.
“This is one of the most sustained DV assaults I’ve come across.”
Presbury pleaded guilty in the court on Thursday to intimidation and two counts of assault causing actual bodily harm.
He appeared at court over audiovisual link from custody.
His family waved to him from the public gallery as his case was heard.
Presbury and his partner were at the Evans Head Car Wash on Hancock Dr when the attack began about 5pm on June 15, police state in court documents.
They were washing a ute together when Presbury began throwing items at her.
He poured coffee on her head before throwing the cup at the woman.
Police state the victim cowered and held her head as “Presbury mocked her”.
“Presbury shoulder barged her into a wall as he walked past her … and struck her causing the victim to hold the back of her head crying,” the documents state.
Presbury slapped the woman and her head hit the corner of a garage roller door.
She retreated and Presbury continued to approach, throwing a car mat at her chest.
“He grabbed hold of the victim’s hair and hoody before spinning her around causing her to fall to the ground,” the documents state.
“Presbury pulled the victim to her feet by her hair, she ran and he grabbed her hair again and tossed her to the ground.”
The woman pulled a pocket knife from her clothing, but dropped it.
Presbury picked up the blade and “rushed at the victim, grabbed hold of the car wash power hose and wrapped it around the woman’s head”.
“Presbury then picked her up and dragged her forcefully toward the passenger seat before they began washing the car together,” the documents state.
Concerned witnesses phoned police and officers found the woman with blood smeared on the back of her neck.
The victim told officers nothing happened and declined to make a statement.
Police spoke to Presbury and he denied the attack – despite having blood on his shirt.
He was arrested and police checked CCTV footage. Officers watched the “violent, confronting and continued assaults.”
Police prosecutor Kim Scott told the court the victim was too scared to report Presbury during the 25 minute attack.
“In the CCTV footage, she’s often seen cowering away from him,” she said.
“He has a lengthy history of DV offences.”
Defence lawyer Rodney David Behan conceded the attack was degrading and violent.
“He (Presbury) suffered a difficult background and began drug use at an early age and has spent a significant period of his adult life in custody or at risk of being in custody,” he said.
“He was released from parole in September and hasn’t been using drugs since.”
Ms Stafford said the public, Presbury’s partner and previous partners needed protection.
He was convicted and sentenced to two years jail with a non-parole period of 15 months.
