A man who carried an unconscious woman to a “secluded” location in Sydney’s inner west and filmed himself groping her has been jailed. Here’s what happened.

A Burwood man who carried an unconscious woman to a “secluded” location and filmed himself groping her has been jailed.

Dinesh Bishwakarma faced Sydney District Court on Thursday after he pleaded guilty to two counts of sexually touching another person without consent and intentionally recording an intimate image without consent.

Judge Robert Sutherland sentenced the 24 year old to five years in jail with a three-year non-parole period, which was backdated to January last year.

Court documents state Bishwakarma was intoxicated when he found a “blacked out” woman sleeping on a bench along Burwood Rd, Burwood, about 3.45am on January 25 last year.

Bishwakarma carried the unconscious 30-year-old woman down the road to a more “secluded” area and laid her down outside Westpac Branch Burwood, police facts revealed.

He filmed two recordings of himself sexually touching the woman, which included rubbing his exposed genitalia on hers.

Bishwakarma fled after a council street sweeper approached and asked him what he was doing.

Judge Sutherland told the court the crown had argued Bishwakarma filming a second recording indicated there was some level of decision-making involved.

The offender told police he knew what he was doing was wrong, but he was not able to stop himself which showed a lack of insight, the judge said.

The Crown said it was irrelevant that no penetration was involved and the offence had lasted a short duration.

Bishwakarma stopped the conduct because he was interrupted by a civilian. There is a high risk of him reoffending if he is let back into the community, the crown submitted.

The court heard Bishwakarma had been in custody for almost 15 months and his behaviour was not planned.

He wrote a letter to the victim wishing her a speedy recovery and acknowledged he had behaved “inhumanely and deserved to be punished harshly”.

Judge Sutherland told the court Bishwakarma was a Nepalese citizen who came to Australia on a visa.

The court heard he grew up in a household with domestic violence but held no “hostility” towards women.

The judge submitted deportation was not relevant in determining a sentence and described his offence as “degrading” and “inexplicable”.

“It is clear the victim was either unresponsive or unconscious and could not give consent,” he said.

“She was awakened by police with her body still exposed and had to be taken to hospital.”

The incident would have resulted in humiliation and psychological consequences for the woman, he said.

The judge said Bishwakarma’s intoxication explained the offending but does not reduce his moral culpability.
