A LOGAN man out for an unexplained midnight stroll in the vicinity of a stolen vehicle which was crashed was arrested when he failed to produce identity when asked by police, instead professing his “liberty” and walking away from the officers.

At 1.30am on February 4 this year, police conducting patrols in the Regents Park area in response to reports of a stolen vehicle which had crashed saw Nikola Nick Ajdarevic, 20, walking on Vansittart Rd.

Today, court heard that in response of questioning by the officers, he responded repeatedly he was “just walking”, before refusing to produce identification (he did correctly state his first name) and walking away, saying it was “all good”.

There is no suggestion Ajdarevic was involved in the stolen vehicle.

Police prosecutor Snr Const Mitchell said Ajdarevic was “evasive and nervous” under police questioning, telling them he was just exercising his “liberty”.

He was detained and ordered to put his hands on the bonnet of the police vehicle for a search. When he repeatedly removed his hands from the bonnet and put them on his chest, he was handcuffed and there was a “wrestle for a short time”, the court heard.

However, Ajdarevic claimed arresting police used “more force than necessary”.

“I was calm, I was just asking officers to comply with my liberty. I was walking near my grandmas. I was in the wrong place at the wrong time,” he said.

Magistrate Clare Kelly summarised his position: “You’re not happy with how you were treated but you accept that by your conduct you obstructed police,” she said.

Ajdarevic pleaded guilty to obstructing police and was fined $150. No conviction was recorded.

Ms Kelly said in light of the report of the crashed stolen vehicle in the area, it was reasonable to ask Ajdarevic to identify himself.

“I would urge you to in future listen to what police are asking you,” she told him.
