Capalaba man in court for threatening violence, breaching bail, contravening DVO

A bayside man, who has been using hard drugs including ice for more than 20 years, verbally abused his own mum before turning on his neighbours, a court has heard.

A bayside man has walked from court after threatening both his neighbours and mum, who he was staying with at the time.

The Capalaba man pleaded guilty in Cleveland Magistrates Court on Tuesday, August 9 to two counts of threatening violence, four counts of breaching bail conditions, and two contraventions of domestic violence protection order.

The court heard the 43-year-old, who cannot be named for legal reasons, attended a local shopping centre with his mother on January 17, demanding she buy him cigarettes and give him cash.

“The defendant returned to the house, again demanding money from the aggrieved,” police prosecutor Sergeant Andrew Duncan said.

“Neighbours heard her sounds of distress and police were contacted,”

“He yelled out to her that he was going to kill himself before running away,” he said.

On April 13 to 16 this year the Capalaba man yelled out to his neighbours several times threatening them.

“He said you better watch out,” Sergeant Duncan said.

“You’re making me a f**king prisoner.

“I wanna bash (the victim).”

His lawyer, Sarah Pascoe, said her client had drug issues.

“He has been using cannabis since 13 years of age and ice since 2001,” she said.

Magistrate Deborah Vasta said his behaviour was concerning.

“It would cause severe distress, threatening to bash them,” she said.

“Your neighbours are putting up with you yelling at your mum non-stop, then you’re pretending to shoot them.

“It’s very sad that you treat your own mum like that.”

He was convicted, sentenced to 40 hours of community service and ordered to have no contact with his neighbours.

“Do not abuse your mother, do not yell at your mother,” Ms Vasta said.

“Do not gesture to them (neighbours), do not look at them.”
