A bayside man, who was told he had the mental capacity of a three-year-old, has faced court for his disgusting behaviour towards his mother.
The 24-year-old bayside man faced court today after breaching a protection order with his mother after she refused to give him cannabis on May 7.
He pleaded guilty to contravening a Domestic Violence Order (DVO).
“He learnt that his ex-girlfriend was pregnant and demanded that the mother give him cannabis, as it was the only way it could calm him down,” the police prosecutor told Cleveland Magistrates Court.
“He yelled and screamed at the aggrieved, yelling at her to give him drugs, lifting a small table, causing it to smash.”
The police prosecutor said the man had a history of breaching the protection order conditions.
On November 22 last year, the court heard the man showed the police messages admitting that they were abusive texts sent to his mother.
“When police arrived at the scene, they observed in plain sight drug paraphernalia and when police arrived he was erratic and heightened,” the police prosecutor said.
“He showed messages to police and said ‘these are messages of me abusing my mum pretty much’.
“These are messages reading f**k your pathetic, shut the f**k up, f**k off c**t, I’m going to give someone a reason to call police soon.
“If you don’t give me the money, I am going to put myself in jail or something worse.”
On another occasion, on December 23, police were called to his mother’s home after he and his friend refused to leave the home.
“The victim told him to get out of the house,” the police prosecutor said.
“After the third attempt to get him to leave, the defendant pushed her back with his hand.”
The man’s lawyer, Bruce Johnson, said his client had issues with drugs.
“He has severe anxiety issues,” Mr Johnson said.
“He is a case study on why people shouldn’t use drugs.
“The situation is this, his ex-girlfriend text messages him to advise him she was pregnant with a longtime friend of his and that’s what triggered everything.
“It’s a very sad indictment of what drugs can do to a person.
“His brain is quite fried.
“When he gets that way he acts like a three-year-old, sort of like a tantrum.”
Magistrate Deborah Vasta said the 24-year-old’s behaviour was horrible.
“It’s a disgusting way to treat your mum,” Ms Vasta said.
“Nothing is going to change till you change it.
“You keep stumbling from one problem to another.
“You’ve turned up to one hour of community service.”
He was sentenced to serve one month jail but was eligible to apply for immediate parole release.
Convictions were recorded.
