A bayside heavy vehicle mechanic has faced court after his poor decision to drive after spending hours drinking on a boat led him to crashing head-on, with a passenger, into a tree.

Sheldon’s Jordan Braye Tierney, 24, was driving back from an evening of fishing on April 18 with a friend when he lost control of his car while towing a boat.

He crashed into a tree on the corner of Chelsea Rd and New Cleveland Rd.

“Police observed a Toyota Landcruiser lodged in a tree at a 45 degree angle, with extensive damage and a damaged boat trailer and tinny in the bush next to the roadway,” the police prosecutor told Cleveland Magistrates Court.

“Police detected the smell of alcohol on his breath and it appeared that he was drinking a number of beers while fishing that evening.

“He returned a reading of .141g of alcohol (nearly twice the legal limit).”

Tierney, who was self represented, pleaded guilty to driving while over the middle alcohol limit.

He told the court he had consumed several drinks beforehand.

“We just got stuck at low tide, so I was just drinking,” he said.

“I really misjudged how much I drank. The car was a write-off.”

Magistrate Deborah Vasta said Tierney and his friend were lucky to be alive.

“I am hoping you get a massive fright from this,” Ms Vasta said.

“I am going to put this down as a very big learning experience for you.”

Tierney was ordered to complete 50 hours of community service, within 12 months.

He was disqualified from driving for three months.

No convictions were recorded.
