Redcliffe man Ryan Wade Mulvahil pleaded guilty to driving under the influence.
The court heard the 40-year-old smashed into a fence on Sydney St at Redcliffe on September 5.
Police prosecutor Sergeant Kay Matheson told the court officers from Redcliffe station were called to attend a single-vehicle accident at 12.30pm.
When officers arrived the vehicle was on the kerb, embedded in the timber fence.
“The defendant was sitting in the passenger seat attempting to roll a cigarette,” Sgt Matheson said.
“(He) made admissions to police that he had been driving the vehicle.
The court also heard how Mulvahil had “struggled to answer basic questions”.
“Police noticed slurred speech as well as a heavy smell of liquor … (they) observed several empty liquor containers at the foot of the vehicle and on the passenger side,” Sgt Matheson said.
Mulvahil’s lawyer told the court the 40-year-old grew up in Ferny Hills and “had a good childhood”.
“He played tennis professionally for a number of years after that until an injury ruled him out,” she said.
“He did go on to study an acupuncture degree and also his myopathy degree, he worked in those industries for around 13 years.
“He’s already taken his own steps at rehabilitation.”
Magistrate Mark Bucknall told the court Mulvahil’s behaviour was “very serious offending”.
“You had the propensity towards serious harm of worse to other members of the public and other road users,” he said.
“This can’t be tolerated, people that intoxicate themselves to the extent that you did need to be dealt with in a serious way that provides a deterrence.”

“At the time … you could smell the alcohol on his breath, he told officers he was driving home however he appeared to be confused about the suburb.
“He said he had been drinking at a mate’s place in Scarborough, he submitted to a roadside breath test.”
Middleton told the Magistrate it “wasn’t one of the smartest decisions he’s made”.
