A Moreton Bay man claiming to be 16 online has been jailed for raping a 15-year-old girl he met via Instagram and indecently treating her twice.
Margate man Keiran Lachlan Graham, 22, who also has an address listed at Bulimba, pleaded guilty in Brisbane District Court on Tuesday to three child sexual abuse offences.
They included two counts of indecent treatment of a child under the age of 16 and one of rape.
All offences occurred on or about August 2, 2019, at Graham’s former Enoggera residence.
Graham met the girl online about a year prior to the offence, the court heard, via an Instagram account where he claimed to be three years younger than he actually was.
The night before the offences, Graham posed via text message as the mother of a friend of the girl, securing permission for his victim to stay the night.
He met her at a Mount Ommaney Shopping Centre, where they caught a bus to his residence.
The court heard the victim told Graham repeatedly, after he confessed to actually being 19, she did not want to have sex that night.
When at his residence, the pair watched a movie at which point Graham told her, “Age doesn’t matter,” and began running his hand up her thigh.
The teen reiterated she did not want to have sex, and alluded to a previous sexual assault of which she “did not want to bring up memories”.
Graham then removed his penis from his shorts and attempted to take off the girl’s shorts.
A short while later, when the girl was “half asleep”, she was disturbed by Graham rolling her onto her stomach, at which point he raped her for “15 to 20 minutes” while she “pretended to be asleep”.
After he stopped, he then gave her repeated hickeys on her neck, collarbone and breast areas.
She left his residence on August 4 and made an immediate police complaint, the court heard.
Graham’s vile offending was committed in breach of a probation order, the court heard.
Graham has been remanded in custody since March 7, 2020, the court heard, after he was required to serve out an eight-month jail term for offending while on parole.
Defence counsel Chris Minnery told the court his client had a prejudicial upbringing and never knew his father.
He said Graham’s disjointed upbringing was such that he couldn’t even remember what year level he stopped going to school.
Mr Minnery said his client further suffered from substance abuse.
Judge Michael Byrne QC sentenced Graham to four years and six months’ jail, and set his parole eligibility as at March 5 next year.
