A magistrate has taken aim at a father’s care for his children after he narrowly escaped jail despite a crime spree at a local gym.

Kallangur resident, Edward James Schreiber, pleaded guilty in Pine Rivers Magistrates Court to more than 20 charges, including breaking and entering, fraud and possessing dangerous drugs.

The court heard the 50-year-old entered a Kallangur gym on June 11, 2020 before breaking into a locker, rummaging through a duffel bag and stealing a wallet, a set of car keys and driving off with the vehicle.

Magistrate Murphy confirmed in court that Mr Schreiber had a lengthy criminal history stretching more than 30 years and questioned why she would give a suspended sentence.

“The last two years of offending non-stop, continuing to break the law, taking peoples cars, stealing, fraud,” Magistrate Murphy said.

“Why should I suspend it, why shouldn’t he actually serve time?”

Mr Schreiber committed the offences despite losing one leg four years ago.

Mr Schreiber’s lawyer argued his health was declining and jail time would not be beneficial to him or his two children.

“He’s unable to utilise his prosthetic leg and is awaiting operation and is a category two patient because of an abscess,” he said.

Magistrate Murphy also spoke of Mr Schreiber's lack of consideration for his children when committing the crimes.

“Caring for your son doesn’t seem to be in your front and centre radar for the last couple of years,” he said.

Mr Schreiber was convicted, sentenced to 16 months parole and was fined $1000 for possessing dangerous drugs and instruments.

Magistrate Murphy said he hoped Mr Schreiber would learn his lesson.

“Hopefully that will be an incentive for you to be in the community without offending,” he said.
