A man has been jailed after he climbed on a neighbour’s roof while ‘heavily intoxicated’, falling through a skylight and then becoming aggressive after police were called.

A “heavily intoxicated” Moreton Bay man fell through his neighbour’s skylight and into their closet, before spitting in the eye of an attending police officer, a court has heard.

Scarborough man Faleaupu Daniel Faalavaau Faleaupu, 30, pleaded guilty in Brisbane District Court on Tuesday to one count of serious assault of a police officer by spitting.

The court heard the offence occurred about 2.30am on January 16 this year outside Faalavaau Faleaupu’s unit complex.

Faalavaau Faleaupu’s “distraught” neighbour had woken to a large bang as the defendant fell through a Perspex skylight and into their walk-in wardrobe.

The court did not hear any detail as to why Faalavaau Faleaupu was on the roof.

Police arrived to find the defendant sitting at the front of the complex bleeding heavily from abrasions to his back.

Faalavaau Faleaupu refused to answer police questions before becoming abusive when he was handcuffed, accusing the officers of racism.

When paramedics attempted to lift Faalavaau Faleaupu into the ambulance, he became agitated and spat in the left eye of a police senior constable who was standing about a metre away.

Faalavaau Faleaupu spent three days remanded in pre-sentence custody before he was bailed.

The court heard he had a violent past, including assaulting a police officer in 2012 and punching a reveller in Fortitude Valley in 2017.

Faalavaau Faleaupu is a father-of-three who works in an Eagle Farm warehouse, the court heard.

He moved to Australia in 2011 from New Zealand.

It was submitted on his behalf that he has a continuing issue with alcohol for which he is seeking treatment.

Judge Suzanne Sheridan sentenced him to serve four months behind bars before his release on 15 months’ probation.
