Beenleigh Magistrates Court on Monday heard police were conducting inquiries on an unrelated matter at Cambridge Cct, Yarrabilba, when they witnessed Kirby riding a motorcycle without a helmet about 3.05pm.
Once Kirby was pulled over, the officers noticed the motorbike had no registration plates and a search of its VIN revealed the bike had never been registered and was thus uninsured.
Furthermore, a licence check of Kirby uncovered the fact he was not authorised to drive the class of vehicle he was on.
The coup de grace came when Kirby’s breath test indicated a positive reading, which was recorded as 0.057 per cent.
Kirby told the court there was “no excuses” for his actions.
He said the pit bike was not his, he’d just fixed it up and wanted to test it out.
Magistrate Michael O’Driscoll said it was “pretty dumb” riding a motorbike sans helmet.
He fined Kirby $1500 and disqualified him from driving for one month.
Convictions were recorded.
