A Logan man has told police he “thought it was funny” to brandish what looked like a black handgun outside a Domino’s pizzeria, scaring children and workers nearby.

Park Ridge resident, Ivica Cech, 37, pleaded guilty in Beenleigh Magistrates Court to one count of possessing explosives without authority and one count of going armed as to cause fear.

The court heard Cech was with his two friends at the Park Ridge Domino’s pizza shop waiting for his order when the pair became loud and obnoxious, causing a bystander eating at a nearby restaurant with his family to speak up.

“(The bystander) prompted them to curb their language due to children being in the area,” police prosecutor Kalinda Cheung said.

The court heard the two friends became aggressive, arguing, before Cech said he was going to retrieve a weapon, which he had initially planned to show his mates because it was funny, but instead spooked onlookers.

“He was seen retrieving a black handgun from the vehicle,” prosecutor Cheung said.

“He has lifted up his shirt revealing the black handgun to those around him.

“A witness proceeded to run back inside the store she was working at and call the police.”

Cech was arrested shortly after, where he told police he thought it was funny.

“He thought it’d be funny to bring the (gel) blaster and shoot his friend ...” she said.

“He stated it was stupid.”

Cech’s lawyer, Bruce Peters, said the gun was a toy, not intended to cause fear.

“Gel blasters are very realistic as toys,” Mr Peters said.

“They have the same weight and look as a gun.

“It’s a harmless toy but the concern is it looks real.”

Mr Peters said his client was attempting to put a stop to the argument.

“He was trying to scare his two friends to break up the fight,” he said.

Magistrate John Costanzo said Cech behaviour was stupid.

“There were children in the area, people objected to the behaviour,” Mr Costanzo said.

“It demonstrates a complete lack of maturity, to be doing that in public.

“There are circumstances where people have behaved like that and got themselves shot for real.

“It’s reckless behaviour.”

Cech was convicted and received three months imprisonment wholly suspended for 2 years.

For an additional charge of possessing an explosive, a shotgun shell, he was convicted and fined $500.
