A Logan man previously convicted of hooning faced jail time for spitting on a cop’s face three times, during an arrest while high on meth.

Nathan John O’Sachy, 27, pleaded guilty in Beenleigh District Court on Tuesday, September 19 to two counts of assaulting a police officer and one count of seriously assaulting an officer by biting or spitting.

The court heard that on April 17 last year in Boronia Heights, police responded to an incident on the street where Browns Plains man O’Sachy was acting erratically.

He was loud, emotional and agitated in the middle of traffic and was under the influence of alcohol and methamphetamine.

Police tried to restrain him but he spat towards a young police recruit.

They assured him they were only there to help but he continued abusing them, as they handcuffed O’Sachy.

He then kicked the cop in the shin and spat twice directly at his face.

“You’re scum you’re going down,” said O’Sachy during the violent arrest.

He was not interviewed by officers at the time because he was so intoxicated.

The court heard the officer who was spat on and kicked, had to get disease testing and suffered a psychological ordeal as a result of the attack.

O’Shay’s offending was considered more serious because he was warned three times not to spit and was previously sentenced for obstructing police in July, 2020.

On July 31, 2020 in Beenleigh Magistrates Court, O’Sachy pleaded guilty to making unnecessary smoke and/or noise and obstructing a police officer after he did a 520-degree burnout and drift in a deserted industrial area.

He was placed on a four-month, $400 good behaviour bond and no convictions were recorded for those offences.

Judge Bernard Porter said spitting at police was more egregious than a regular attack on cops.

“Parliament has said this is a lot worse than ordinary assaults and if we don’t act, nobody will want to be police officers,” he said.

“I’ve taken into account your personal background and despite a dysfunctional upbringing, you have made something of yourself.”

Judge Porter took time to consider a custodial order, where three months of the head sentence would be served behind bars.

O’Shay was sentenced to 12 months prison, but suspended immediately with no jail time to be served.

He was placed immediately on parole for the 12 month period.
