A Logan IT worker has faced court for a violent, choking rampage against his partner during which he headbutted her and punched walls.

A Logan IT worker has faced court for a violent, choking rampage against his partner during which he headbutted her and punched walls.

Kyle Robert Fabian, 24, pleaded guilty to choking (domestic violence offence) in Beenleigh District Court on Monday, September 25.

The court heard that on June 7 last year in Bethania, Fabian was woken up by his partner of seven years after sleeping through his alarm.

An argument ensued in which the Tanah Merah IT worker grabbed her by the neck and pinned her against a wall before shouting “I’ll kill you”.

Fabian also punched and headbutted walls repeatedly.

He was under the influence of cannabis at the time, the court heard.

The victim told police she felt light headed, could not breathe and suffered bruising and redness to the neck.

Prosecutor Madeleine Jones said the attack had a significant, emotional impact on the victim.

“The defendant committed violence within the sanctity of the victim’s home and he was affected by drugs,” she said.

Fabian told the court he felt terrible for the hurt he caused and was ashamed of his actions.

He had since taken steps to rehabilitate and had not offended since the incident.

Judge Bernard Porter said choking was always considered severe by the courts.

“Choking is a very serious offence, particularly for the powerlessness it instils upon the victim,” he said.

“It often underpins domestic violence.”

Fabian was sentenced to 15 months’ prison, wholly suspended for three years.

He had already served 126 days of pre-sentence custody.
