A Logan landscaper’s unprovoked holdup of a customer outside an Indian restaurant with a knife, has been described as ‘amateurish’ and ‘terrifying’ in court.

Beenleigh District Court heard on Monday, May 23, that Dylan Wayne Ayers, 27, was outside an Indian restaurant in Browns Plains when he asked a customer for some money.

The man refused and then pulled out his phone, where Ayers, from Regents Park, thought he was calling the police and confronted the customer.

The court heard Ayers started touching him in the chest and the man pushed Ayers away and told him to keep his distance.

The victim told police after Ayers smelt like liquor and looked intoxicated.

The two men were shirtfronting each other when Ayers said “you see this”? and pointed to a knife at his waist.

Ayers then grabbed the man’s glasses, threw them on the ground and stepped on them.

He then took the man’s car keys and went to get in his car as the man began yelling for help.

Ayers threw the car keys on the ground and walked away and was arrested three months later.

He pleaded guilty to armed robbery in company with personal violence and wilful damage for the September 29, 2020 offence.

Prosecutor Kelli Lemass said the robbery was unprovoked and not well thought out.

“It was spur of the moment amateurish conduct and was consistent and protracted in nature,” she said.

“It was done with deliberate determination and would have been a terrifying event for the victim.”

The court heard Ayers had just broken up with his partner at the time of the robbery and was heavily drunk and affected by the drug Xanax.

The court heard Ayers worked as a casual landscaper and was seeking counselling for his reliance on alcohol and drugs.

Judge Craig Chowdhury said armed robbery was an extremely serious offence.

“The circumstances of these offences are bizarre, you were seriously affected by liquor and drugs but that is in no way an excuse,” he said.

“Your rehabilitation prospects however are good.”

Ayers was sentenced to two and a half years prison to be immediately released on parole.

His parole period will run for two and a half years.
