A Logan pharmacist has faced court for her involvement in a home invasion where a teenager was allegedly threatened at gunpoint, beaten and stomped on in front of his 15-year-old brother.
Belmont woman, Anne Tracy Bourke, 45, and another man allegedly broke into a Woodridge home on August 20, 2021, where two brothers, aged 15 and 17, were staying.
The couple allegedly broke into the home, armed with a gun, demanding $400 from the teenage boys which was owed to them after they lent money to their mother.
The 17-year-old boy asked Bourke and alleged co-offender to leave before the argument became violent.
“The complainant punched the co-offender twice and asked them to get out of the house,” crown prosecutor Larissa Peddell alleged in Beenleigh District Court.
“The co-offender hit the complainant once with the head of the barrel, he then struck him six to seven times in the face and the body with his fists before stomping on his neck twice.”
The court heard Bourke encouraged the assault, telling her alleged co-offender to shoot the 17-year-old.
“She actively, verbally, encouraged him to shoot the complainant,” Ms Peddell said.
Her lawyer, James Wallace, said his client – who had pleaded guilty to assaults occasioning bodily harm, breaking and entering while armed and threatening violence – had a successful career before she turned to drugs.
“Ms Bourke did very well for herself for two decades, educating herself and becoming a pharmacist,” Mr Wallace said.
“She began to use methamphetamines in 2020.
“She lost her registrations as a pharmacist, she went to jail for a time.
“That really is the rock bottom for Ms Bourke.
“She has gone from being in a full time job to being involved in a home invasion over $400.
“She is genuinely remorseful for her conduct.
“She indicates that matters escalated far more than they should have and she accepted that it should have just never had happened.”
Judge Jodie Wooldridge said Bourke’s actions were violent.
“She’s actively encouraging the co-offender to shoot the 17-year-old,” Ms Wooldridge said.
“Yelling to your co-offender to, “just shoot him, just shoot him”.
“Your co-offender then stood over the complainant, pointing the gun at him, saying, “do you want to die? Do you want to get shot?”.
“Further to what was said by your co-ofender, you said, “Just shoot him c---”.
The court heard Bourke threatened the victim’s mother after the attack.
“Threatening that you would tell the police that the money (she borrowed) was drug money if you or your co accused were questioned,” she said.
“This would have been a frightening experience for the complainant and his brother who witnessed the events.”
Ms Wooldridge said the injuries to the 17-year-old victim were extensive.
“He received treatment at the hospital for injuries to his face, neck and shoulder,” she said.
“He required stitches above his right eye, smaller cuts to his cheek were glued, he had haematomas to his neck and jaw and a burst blood vessel in his right eye.”
Bourke was convicted and received a head sentence of two years and six months imprisonment.
She will be eligible for parole on October 11.
Convictions were recorded.
Her co-accused – who entered a plea of guilty – will face court in May this year.
