A new dad has faced court after he assaulted a security guard who accused him of having inappropriate photos on his phone at a popular tavern, moments after he attended a baby shower.

A new father has faced court after assaulting a security guard at a popular Logan tavern, moments after attending a baby shower.

Bahrs Scrub resident Dylan Dakota Casey, 28, attended the baby shower before going to the Windaroo Tavern on March 19 last year, Beenleigh Magistrates Court heard.

“There was an incident that occurred at the Windaroo Tavern where there was a punch to the complainant, causing his lip to split and bleed,” police prosecutor Donna Kay said.

“I understand the victim (aged 44) is now deceased, not as a result of this.”

Casey’s lawyer, Tamara Lawton, said her client - who had pleaded guilty to assault occasioning bodily harm - had been “antagonised’’ on the day of the offence.

“My client and his partner had been at a baby shower, where he did consume several drinks,” Ms Lawton said.

“He then attended the Windaroo Tavern.

“It was during the time where patrons had to show security proof of their COVID-19 vaccinations before entering.

“My client instructs he opened the app on his phone and the security officer mistakenly thought that he had the power to touch my client’s phone to see if there were any other materials on the phone.

“He was highly embarrassed by what he was accused of having on his telephone.”

Ms Lawton said her client and his partner returned home, where Casey consumed more alcohol before deciding to return to the tavern.

The more he dwelled (on the incident with his phone), the more he became angry,” Ms Lawton said.

“(When he returned to the tavern) He saw the victim outside and followed him into the tavern.

“They exchanged words before it got physical.

He’s thankful that the injuries appeared to be minor.

He accepts the consequences and repercussions of his poor behaviour.

“He was really quite ashamed and embarrassed.

It was not long after this incident that he found out his partner was pregnant.

“His life now consists of going to work and coming home and being a family man.”

Magistrate Michael O’Driscoll said Casey should not have initiated any violence.

“If you weren’t happy, you needed to walk away,” Mr O’Driscoll said.

“Any violence cannot be condoned. Keep your hands to yourself.”

Casey was fined $1000 for one charge of assault occasioning bodily harm.

No convictions were recorded.
