A Logan business owner has claimed 40kg of marijuana discovered in his home was for personal use. Bizarrely, he was also found with a 160-year-old antique gun.

A Logan business owner has narrowly avoided jail time after being found with 40kg of pot, which he told a court was not for commercial use, and an antique gun.

New Beith’s Adam Terry Joseph Talbot, 29, pleaded guilty in Beenleigh District Court on Friday (May 12) to charges of possession of cannabis over 500 grams and possession of weapon.

On July 28 last year, Talbot’s home was raided by police who found vacuum-sealed bags, boxes of cannabis and an antique firearm made in 1859.

The court heard there was no evidence of “commercial exploitation’’ and some of the drugs was for personal use.

After deliberating on whether to sentence Talbot to an actual jail term, Judge Terry Gardiner decided to spare him a custodial sentence.

“It would be counter-productive to incarcerate you, notwithstanding the significant quantity of marijuana you possessed,” Judge Gardiner said.

“You have made substantial efforts to rehabilitate and it is important you continue that.”

The court heard Talbot was heavily involved in training at his gym and was living a more healthy lifestyle since his arrest.

He paid active attention to nutrition and was focusing on his business.

The court heard he was very hard working and was now prescribed medicinal cannabis.

Talbot tendered a letter of apology to the court and six references from family members and friends.

He was sentenced to two years in prison and released immediately on parole.
