A Redlands man coming down off a four-day ice bender used the presence of children in the home to coerce his ex-partner into submission with a court hearing of her “indescribable sense of betrayal”.

A Redlands man in his 30s has been sentenced to six-and-a-half years’ jail after raping his Logan partner of 14 months and mother of his child “to ejaculation”.

Beenleigh District Court heard the Dunwich man, who cannot be named for legal reasons, was a violent offender who had spent about 11 years in custody since 2007, most seriously due to a previous rape committed that same year.

On that occasion, the defendant “left for dead” an 18-year-old girl unknown to him who he bashed, causing her grievous bodily harm, before “vaginally and anally raping her” in public.

She was found clinging to life the following morning by passers-by.

He received a nine-year head sentence for that offence.

The rape before the court today occurred in late-2018 at the victim’s home in the Logan region.

The defendant, who had separated from the victim, was at her house to wash his clothes when the pair hugged.

This led to the defendant “restraining” the victim on the couch before “raping her to ejaculation”.

The court heard he used the presence of children in the house as a coercive factor.

After the rape, the defendant called the police to dob himself in, making admissions and saying he wanted to go back to prison, Crown prosecutor Stephen Muir said.

“His reason for co-operation was he wanted to return to jail,” Mr Muir said.

Defence counsel Anna Cappellano told the court prior to the rape currently before the court, the defendant had moved to Stradbroke Island to live with his mother where he became “severely depressed” following a bout of rheumoid fever.

This drove him to link up with an old friend and the pair engaged in a “four-day meth binge... the most he’d ever had”, Ms Cappellano said.

It was in the aftermath of this, when he was “withdrawing” from the drug, when the rape occurred.

Harrowing extracts from the victim’s impact statement were read onto the public record.

“You’ve left my daughters and I broken-hearted,” she said.

“There’s an indescribable sense of betrayal.

“You’ve robbed your daughter of the chance to get to know her father.

“I’m so angry but I do not carry hate.

“You are not a bad man but you have made very bad decisions.”

The defendant was sentenced to a six-and-a-half year head sentence.

He will be eligible for parole on December 21 this year, having been behind bars since January 26, 2019.
