Police claim Marsden man Kody Baden Rose, 19, scratched, choked and pulled the hair of his ex-girlfriend in a three-part assault of the woman during a gathering at the defendant’s place about 6.30pm on Monday night.

In court today, Beenleigh Magistrate Clare Kelly refused Mr Rose bail on the two charges of common assault and choking after it was heard Mr Rose had a number of outstanding matters, including entering premises with intent, where he is alleged to have stolen $54,000 of tobacco products from two service stations he broke into in January this year.

Mr Rose also has a number of outstanding charges of breach of bail, the court heard.

He was arrested yesterday for Monday night’s alleged assault after he reported to a police station as part of his prior bail conditions.

The court heard the alleged assault occurred after a significant period of alcohol consumption, with multiple people, including the defendant and alleged victim, at Mr Rose’s Marsden address.

Police say Mr Rose attempted to take a pair of car keys off the alleged victim, which he claims were his, when he became violent.

Police claim Mr Rose initially pushed the alleged victim off a chair, telling her, “Give them to me or I’ll do something I’ll regret.”

He was allegedly calmed down by witnesses, before falling asleep briefly in a drunken stupor.

However, when he woke, he continued haranguing the woman, according to police, who say he then screamed at her, “Give me the f****** keys,” before snatching her mobile off her.

She allegedly tried to retrieve the phone, at which point Mr Rose grabbed her by the wrist and held the phone up high out of her reach, warning her, “If you call the police I’ll stomp on your head”.

Police say the alleged victim then fled to a garage, where Mr Rose kicked in the door, striking and lacerating her foot.

When she attempted to escape via the front door, Mr Rose grabbed her by the neck with “strong pressure” until she was gasping for air, police say.

At this point the other witnesses in the home, who tried to separate the pair on three separate occasions, the court heard, managed to push Mr Rose out the door and lock it, at which point they called police.

Defence lawyer Raquel Brehmer told the court Mr Rose had no history and had not been convicted of any offences.

She also noted her client “completely contests” the charges despite, by his own recollection, being unable to remember the argument in question.

In refusing bail, Ms Kelly said she was concerned by the apparent “protracted” nature of the assault.

Mr Rose’s charges will be mentioned again on September 30.
