Seaford train rapist Dylan Lloyd in Supreme Court as prosecutors look for indefinite intervention order

A man who pleaded guilty to sexually assaulting a girl on a busy Adelaide train in daylight has spent the past five months in a prison infirmary, a court has heard.

A 22-year-old autistic man who sexually assaulted a 12-year-old girl on a Seaford line train has spent the past five months in a prison infirmary, a court has heard.

Dylan Lloyd, from Aldinga Beach, appeared in the Supreme Court on Monday in front of Justice Laura Stein – where Talia Costi, for the prosecution, continued for an application for an indefinite detention order.

Andrew Williams, for Lloyd, said he didn’t “accept” the prosecution’s application, but was willing to “go through with the process”.

“It would seem to me that this is just a process – we obviously don’t accept that,” Mr Williams said.

“My client is autistic and has had a difficult time in prison.

“He’s been in the infirmary – or the equivalent – ever since January.”

Last month, Lloyd appeared in the District Court where Ms Costi said she would argue he should be dealt with under Section 57 of the Sentencing Act, which deals with the indefinite detention of sex offenders. Judge Anthony Allen said it was appropriate to refer Lloyd’s case to the Supreme Court for determination.

Under the act, a person who is deemed incapable of or unwilling to control their sexual impulses is to remain in prison past the expiration of their prison term. That detention ends only when and if two mental health experts agree the offender has demonstrated the willingness to control themselves in public.

In February, Lloyd pleaded guilty to one count of indecent assault and one count of unlawful sexual intercourse with a person under the age of 14 years.

He committed both offences against the same victim in January 2024, on the Adelaide-bound train between Christie Downs and Park Holme.

On Monday, Justice Stein ordered both the reports of the two qualified medical practitioners, and the report from Department of Correctional Services to address the behaviour of Lloyd while in custody.

She remanded Lloyd to face court again in November.
