The case against a Bowen man accused of a fatal hit and run has again been delayed with questions over missing evidence.
It is alleged Joel Mark Wayne was behind the wheel and failed to render assistance on the night of a fatal crash that caused the death of a cyclist.
The incident occurred on July 25, 2024, when police allege Mr Wayne struck a 69-year-old cyclist on Bootooloo Rd, leaving him on the side of the road.
A passing driver later found the victim, who died from his injuries.
Mr Wayne is also charged with a string of other offences in the days before and after the incident including drug driving, driving uninsured, driving while disqualified, not following directions of a police officer, assault causing bodily harm, armed robbery, and possessing dangerous drugs among other offences.
Solicitor Peta Blundell acting as town agent for Rennick Lawyers in Bowen Magistrates Court said the defence had received some documents from the brief and now needed time to take instructions from Mr Wayne.
Magistrate Michelle Howard adjourned the matter to allow defence time to speak with Mr Wayne.
Mr Wayne who is currently in custody will not need to appear in court on the next occasion.
His matters were adjourned to 18 February, 2025.
