Joel Mark Wayne’s alleged fatal hit-and-run case adjourned in Bowen court

Missing DNA results are holding up the case against a Bowen man accused of running down a cyclist and fleeing the scene in an alleged hit and run horror that shocked the community.

Joel Mark Wayne is accused of being behind the wheel and not rendering assistance when the fatal incident occurred on July 25, 2024, along with a string of other offences in the days before and after the incident.

Police allege Mr Wayne struck a 69-year-old cyclist on Bootooloo Rd, leaving him on the side of the road.

A passing driver eventually found the victim, who died from his injuries.

Police have also charged Wayne with drug driving, driving uninsured, driving while disqualified, not following directions of a police officer, assault causing bodily harm, armed robbery, and possessing dangerous drugs among other offences.

It is further alleged he was involved in the robbery the day after the alleged hit and run.

Solicitor Peta Blundell acting as town agent for Rennick Lawyers in Bowen Magistrates Court said the defence had not yet received full briefs of evidence from the prosecution relating to the armed robbery, dangerously operating a vehicle causing death, or the unlawful possession of a weapon matters.

The court heard that partial briefs had been sent this week to Rennick Lawyers with some materials including DNA testing potentially still outstanding.

Magistrate Michelle Howard adjourned the matter to allow time for all materials to be provided to the defence.

Mr Wayne who was currently in custody will not need to appear in court on the next occasion.

His matters were adjourned to December 17.
