Timothy John Scope and Luke John Potter in court for Duporth Tavern charge

Two Sunshine Coast men who got into a physical fight with security at a popular Maroochydore pub have been punished in court, with one man told to find another place to drink.

Two Buddina men who got into a physical fight with security at Duporth Tavern have been punished in court with one man copping a sizable ban from the night-life strip.

Timothy John Scope, 32, and Luke John Potter, 48, faced Maroochydore Magistrates Court on June 29, 2022, and each pleaded guilty to a charge of public nuisance.

Scope also pleaded guilty to obstructing police.

Police prosecutor David Hoffman said staff members from Duporth Tavern asked for police assistance after two drunk patrons were refusing to leave the venue on June 12, 2022, at 3.20am.

The staff stated the patrons were causing a disturbance and were fighting with security.

When police arrived at the tavern they saw Scope and Potter in a physical fight with security guards.

The guards were struggling to remove the two men from the premises, the court was told.

Senior Constable Hoffman said police intervened and separated the co-offenders from the security guards before escorting the two men out.

The court heard Scope was aggressive and confrontational with police by resisting arrest and kicking out towards them.

The pair were arrested and taken back to the watch house where they were charged.

Security staff declined to make a complaint to police, the court heard.

Duty lawyer Chris Lumme represented both men and said Scope grew up in a dysfunctional household and developed a drug addiction that he had managed to overcome.

Mr Lumme told the court Potter worked full-time and had no criminal history.

Magistrate McLaughlin said Scope, who worked as a landscaper, would need to find “somewhere else to drink” and banned him for 12 months from Ocean St.

No convictions were recorded for either of the men.
