A Kuluin business owner who was found with more than a kilogram of drugs, some found in an Aldi shopping bag, has claimed in court it was for his personal use.
Jayson Joseph Andrew Saleh, 42, escaped actual imprisonment after pleading guilty to possessing drugs over the scheduled quantity, possessing property suspected of being used in connection with a drug offence and possessing utensils.
Maroochydore District Court heard the father-of-three and former hospitality worker had his family home raided by police on December 17, 2021 in Kuluin in the search for drugs.
Crown prosecutor Joana Dias said during the search warrant 1.325kg of marijuana was found, including a vacuum seal bag inside an Aldi bag containing 0.449g of weed.
The court heard more marijuana was also found in his “smoking room” downstairs.
Ms Dias said other amounts were found throughout the house, along with scales and a bong.
Saleh told police the drugs were personal use and bought it in bulk, with the Crown alleging no commerciality.
Defence barrister Kelvin Pearson said the 42-year-old Kuluin man had been using marijuana for spinal pain after a past car accident.
Mr Pearson said Saleh also used the marijuana to make cannabis oil and would often buy the drugs off the street, using his scales to weigh the oil.
The court heard Saleh had bought a business prior to the pandemic with his family now in a dire financial situation.
Mr Pearson said the Kuluin dad would be using medicinal cannabis for his previous injuries but would seek other medical alternatives.
For possessing drugs Saleh was sentenced to six months’ jail, suspended for 12 months with a conviction recorded.
He was not further punished on the two summary charges with no convictions recorded.
