A concerned driver who pulled over to film hoons doing burnouts was spat on and had the side mirror of his car ripped off by a teen during a “disgusting” attack.
Jarra Hall was fined $1000 in Maroochydore Magistrates Court on Monday after he pleaded guilty to common assault and wilful damage.
Police prosecutor David Hoffman told the court the victim had pulled over to capture a Ford sedan performing burnouts at a Mountain Creek intersection when Hall approached his open passenger window.
“ … (Hall) has continued to yell abuse at the victim and has spat saliva onto the side of the victim’s face,” Senior Constable Hoffman said.
“This saliva has landed on the victim’s glasses, left cheek and the top of his shirt.”
The court heard Hall caused a total of $2941.20 in damage to the victim’s car when he smashed the mirror and damaged the side of the vehicle.
The victim had to pay $500 in excess to have his insurance cover the damage.
Constable Hoffman said the victim was trying to take more photos of the cars involved when the 18-year-old spat in his face again.
He said police were called to the victim’s house and observed spit on the man’s glasses and shirt.
Constable Hoffman said it was a “disgusting offence” and suggested fines or a period of supervision to deter future offending.
Duty lawyer Rachel Holland said the 18-year-old had bought a house with money left to him by his late mother and regularly paid the mortgage.
Ms Holland suggested a fine and asked for no conviction to be recorded.
Hall was extremely remorseful for his actions and agreed his behaviour was “absolutely disgusting”.
He told Magistrate Haydn Stjernqvist he was not driving the car that was seen doing burnouts.
Mr Stjernqvist said Hall’s actions after he took issue with the victim taking a video “defied belief”.
“I find that unbelievable that you could get out of the car, approach him, damage his property by ripping his mirror off and spitting on him twice,” he said.
Hall was ordered to pay $500 compensation and $500 restitution to the victim.
A conviction was not recorded.
