Anthony Robert Terrence Barkle in court over assault at Gympie’s Phoenix Hotel

An overprotective son screamed in the face of a pub manager, who had denied his intoxicated mother service, before kicking him in the stomach in a drunken attack.

A Sunshine Coast hairdresser who became aggressive after his mother was cut off from drinks at a Gympie pub, kicked a manager in the stomach and threw a drink over him, a court has heard.

Anthony Robert Terrence Barkle, of Warana, was placed on a $1500 good-behaviour bond for two years after he pleaded guilty in Maroochydore Magistrates Court to assaulting a Phoenix Hotel assistant manager in Gympie on July 7.

Police prosecutor Mark Burrell said Barkle was extremely aggressive and screamed profanities in the face of the assistant manager, who had denied his intoxicated mother service.

The court heard the assistant manager had spotted Barkle’s mother sipping another beer when he also removed the hairdresser’s beer.

Senior constable Burrell said the 31-year-old Warana resident threw the glass of water over the victim’s face and shirt.

Barkle’s mother was standing in between the Warana man and the victim, trying to get her son to leave, when he continued to yell and scream, calling the victim a “f. kwit” and a ”stupid c. t”.

“ (Barkle) … then held onto his mother and kicked the victim in the stomach with his left leg, he then pushes his mother to the side and kicks out three more times striking the victim in the upper thigh and calf,” senior constable Burrell.

Barkle, who was asked to leave the venue several times before the assault, also pleaded guilty to failing to leave a licensed premise.

Senior constable Burrell said Barkle was lucky to be charged with common assault after the violent incident.

He said a suspended sentence or a substantial fine was an appropriate sentence.

Duty lawyer Rachel Holland said Barkle’s upbringing made him protective of his mother.

“This person that came over had no ID, he was wearing clothes your honour might wear to the pub … there is nothing identifying him as security guard or a worker,” she said.

“Initially he didn't know who this person was, he just thought it was a person taking his mum’s drink.”

Ms Holland said Barkle’s had “way too much” to drink on the day.

“His over protectiveness was exacerbated by alcohol,” she said.

“It’s not an excuse but it is an explanation to why he behaved the way he did.”

Magistrate Rob Madsen challenged the idea Barkle was acting out of concern for his mum, saying the assistant manager was never threatening towards her.

He said the fact that Barkle was “extremely drunk” was a better explanation for his bad decision.

Barkle was ordered to pay $200 compensation to the assistant manager and will also take part in a Drug and Alcohol Assessment Referral course

He was banned from the Phoenix Hotel.
