Lewis Charles Bellerby in Maroochydore court for breaching suspended sentence

A Noosa plasterer who organised a group of people to terrorise another man at his Mapleton home has had his sentence extended after being found with a pipe.

Lewis Charles Bellerby, now 38, had his sentence of four years prison to be suspended for five years extended by one month on July 18, 2022, after being found with a drug utensil.

The court heard Bellerby was dealt with in the Maroochydore District Court in May 2021 for an incident where he went to a man’s house in Mapleton in the early hours of the morning on December 29, 2019.

At least one of the offenders was armed with a pistol and the victim armed himself with a machete and a pole.

The offenders approached the house and the victim tried to defend himself.

One of the offenders who had a handgun discharged it at the victim but fortunately missed.

The remainder of the offending on the night involved the stealing of a gun and causing damage to a car.

The court was told Bellerby did not physically partake in the violence and he was sentenced on the basis that he planned and organised the attack.

Bellerby was also given a three year probation order for the 2019 incident.

Bellerby’s recent breach involved him being found with a homemade water pipe and a glass pipe, for which he was fined $900 in Noosa Magistrates Court.

Defence solicitor Bernard Bradley said his client was now prescribed with medicinal cannabis to help with a work injury to his neck.

“He’s had a quote for $40,000 for surgery ... he is a plasterer and is hiring two plasterers,” Mr Bradley said.

Mr Bradley told the court Bellerby had been performing well under probation.

Judge Long said no action would be taken in regards to Bellerby breaching his probation order.
