A “well liked” drunken and naked schoolteacher kicked and growled at police officers when they showed up at his door, a court has been told.

Dirk Alexander Oliver pleaded guilty at Murgon Magistrates Court to one count of obstructing a police officer.

The Murgon secondary school teacher was naked and verbally abused and “growled” at police when they attempted to restrain him after they were called to his Wondai home.

Police prosecutor Barry Stevens told the court a neighbour called police on June 30, who reported a woman yelling “please don’t hit me”.

Murgon police arrived at the house about 8.50pm and entered after speaking to a woman.

Oliver was in the shower when police arrived and after speaking to him through the bathroom door he began swearing at them.

“The defendant was shouting and swearing at police saying ‘f--k off, get the f--k out of my house’,” Mr Stevens told the court.

Oliver eventually opened the door and was naked. Police asked him to put clothes on but he refused, the court heard.

Mr Stevens said Oliver told police to “walk the f--k away from me”.

A second police unit arrived and Oliver continued to yell at them until he asked them to arrest him, Mr Stevens said.

“Police attempted to de-escalate the situation,” Mr Stevens told the court.

“He was calling police ‘useless c---s’ … it was obvious to police that he was intoxicated,” Mr Stevens said.

“They were trying to calm him down but without success, this went on for some time.

“He said, ‘do whatever the f--k you want, arrest me’, he put his hands up in the air.”

The court heard several officers attempted to restrain him but he was resisting.

The partner also became involved but was restrained and taken into another room.

“He was taken to the floor … he was kicking his arms and his legs and he was growling at the police,” Mr Stevens said.

Mr Stevens told the court the altercation went on for about 10 minutes.

Eventually police were able to secure the handcuffs and put some trousers on Oliver.

Police called an ambulance to do a mental health evaluation on Oliver and he was taken to hospital.

On August 1, police went to see him to give him a notice.

“He continued to call the police a f--k head,” Mr Stevens said.

Oliver’s solicitor said there were many events that occurred “in a very short period of time” leading up to the event.

They said he had a shot gun pulled on him while he was walking his dogs and when he reported the incident to police he felt there was a “lack of assistance”.

“There was a tragedy in the family that morning (too),” they said.

“He had been drinking heavily … he was not in his right mind at that time.”

His solicitor told the court Oliver was embarrassed and remorseful and it wasn’t typical behaviour for him. He said Oliver is a “very well liked secondary teacher”.

Magistrate Andrew Sinclair agreed Oliver was remorseful and fined him $350 with no conviction recorded.
