A magistrate has slammed a repeat unlicensed driver for his ridiculous excuses, with the man adamant his offending was simply the result of a good deed to help the partner he would go on to brutally assault and choke.

A magistrate has slammed a repeat unlicensed driver for thumbing his nose at the court, describing him as a hypocrite for blaming his offending on his partner.

Tyreece Elijah Mervyn Simpson, 21, faced court on a string of nine charges including three counts of driving while disqualified by a court order.

Between July 16 and September 14, 2021, he was repeatedly found driving a car and motorcycle in Cherbourg and Kingaroy despite only weeks earlier being banned from driving by a court.

Simpson was also charged with failing to surrender a car to police after being issued with an impoundment notice.

When police arrived to question why he failed to comply, Simpson declared he had no licence and could not drive.

Just a month later on August 15, police spotted the car driving in Kingaroy and intercepted it and again found Simpson behind the wheel.

Prosecutor Sean Franklin told the court the 21-year-old gave police a strange excuse for being on the roads.

“(He said) he was going down the road to get some KFC, and said he was only driving to help his partner who suffers from anxiety was not able to drive,” Sgt Franklin said.

In April, Simpson was sentenced to two and a half years in jail for viciously assaulting this same partner.

Simpson has been in custody since September 15 2021, and Sgt Franklin submitted a jail term was appropriate for the disqualified driving.

“He’s continued to drive for no real reason whatsoever, almost within a month of being disqualified by court order,” he said.

Simpson pleaded guilty to three counts of disqualified driving, drink driving, driving an unregistered and uninsured vehicle, riding a motorbike without a helmet, failing to produce a vehicle are required, and possessing a knife in public.

Magistrate Andrew Sinclair told Simpson he was “poking fun at everyone else in society” by continuing to drive unlicensed, and slammed his excuse.

“The hypocrisy of that is highlighted by the fact that you claimed it was to help the partner which in my calculations a month later you choked in a domestic violence context and assaulted causing bodily harm,” he said.

Simpson was sentenced to 90 days jail, fined $350 and disqualified for three years.

He was released on immediate parole.
