South Burnett man called ‘worst domestic violence offender’, abuses magistrate

A repeat domestic violence offender described by a magistrate as ‘the worst’ he’s ever seen exploded in an abusive rant in the court, telling the magistrate to ‘get fu--ed’ when he demanded an apology.

Australia's domestic violence crisis

A serial domestic violence offender has been told to choose between issuing an apology or facing a contempt of court charge, after a shocking courtroom outburst where he called officials “co--suckers” and “piss-weak c--ts”.

A late afternoon bail hearing descended into a farce when the 50-year-old, who is charged with three counts of breaching a domestic violence order, went on a foul-mouthed tirade at a magistrate.

His application for bail ignited tensions as police prosecutor Sean Franklin presented his objection, noting the man’s extensive criminal history.

“This defendant has 24 previous convictions for domestic violence offences, including offences of violence, wilful damage and contraventions of protection orders,” Sergeant Franklin said.

“He is a recidivist offender. Bail is not going to ameliorate any risk. He does not comply with court orders.”

Sergeant Franklin said the man faced 12 months’ jail if convicted on the breaches, with Magistrate Andrew Sinclair noting he believed it would be at least two years.

The man, who refused legal assistance, was then given an opportunity to tell the court why he should be given bail.

After several minutes of his telling the court police had no evidence of him committing crimes, with a focus on a lack of CCTV evidence, the man’s bail bid was denied.

“The defendant is one of the worst domestic violence offenders I’ve ever seen,” Mr Sinclair said.

“There are no bail conditions on which he could safely be released. He’s a danger to the aggrieved.”

As he was being led from the dock, the 50-year-old had some choice words for the court.

“Ya c--ksuckers. piss-weak c--ts,” he yelled.

Mr Sinclair ordered him returned to the dock, demanding an apology.

“Get f--ked. You won’t get no apology from me,” the man said.

Mr Sinclair gave him until July 19 to apologise, while he considered if the man should be charge with contempt of court.

The man was remanded in custody until July 12.

Prosecutor Sean Franklin told Kingaroy Magistrates Court in early May this year it was alleged the man repeatedly went to the home of a former partner and harassed her, including calling her a “lesbian” and assaulting her in a car.

The man is subject to a domestic violence order that prevents him from contacting the woman.

He entered pleas of not guilty and Magistrate Andrew Sinclair order a full brief of evidence be compiled.
