A young Kingaroy father hurled abuse and threatened violence towards police officers while intoxicated at his family home, a court has heard.

Benjamyn Jacob Hicks, 31, pleaded guilty on Thursday at Kingaroy Magistrates Court to one count each of committing public nuisance, obstructing a police officer and obstructing a police officer in a public place adversely affected.

Police prosecutor Barry Stevens said police attended a domestic disturbance at Hicks’ home on March 26 2023.

“He was seen to be arguing and threatening violence, while grossly intoxicated,” sergeant Stevens said.

“There was a strong smell of liquor and he was verbally abusive and belligerent to the officers.”

Hicks told police if they touched his child he would “f---ing kill the c--ts”, the court heard.

Sergeant Stevens said Hicks told one officer “I’ll punch your d--k in”, before he was detained.

The court was told Hicks dragged his feet, dropped to the ground and refused to move his arms while police tried to cuff him.

“At the watch house he had his cuffs removed and wouldn’t comply and then refused to enter his cell,” sergeant Stevens said.

Solicitor Jay Rose said Hicks is a carer for his three children and he had not drank alcohol for three years prior to the incident.

“He was celebrating his partner’s 21st birthday and has no recollection of the evening,” Ms Rose said.

“He is willing to do community service,” she said.

Magistrate Andrew Sinclair took Hicks’ guilty plea into consideration.

“I understand that you must have been severely affected by alcohol,” Mr Sinclair said.

“The community service will give you some time to reflect.”

Hicks was sentenced to 60 hours of community service to be completed in the next six months.

Mr Sinclair said given Hicks’ limited history no conviction was recorded.
