Rockhampton’s Jamie William Aspinall ordered brother to destroy CCTV

A Queensland prisoner who once robbed a Pizza Hut called his brother from jail under a fake name asking him to destroy crucial evidence against him.

A Queensland prisoner called his brother, asking him to destroy crucial evidence that could led to police slapping him with “60 or 70 further offences”.

Jamie William Aspinall, 38, was jailed at Capricornia Correctional Centre for domestic violence offences when he made the call on May 22, 2023, Rockhampton District Court heard on May 10.

Crown prosecutor Cameron Keast said Aspinall, who had previously been convicted for a spate of robberies with six co-offenders in 2010, including one of Pizza Hut, was serving a 12 month prison term when he made the call seven days after being taken into custody.

It was only three days earlier that Aspinall gave a false name for a phone number he wanted registered as a number he could call from prison.

Mr Keast said Aspinall did this on three occasions – May 19, 24 and 28 – where he called his partner, arguing with her, urging her to get the latest charges against him dropped.

He said Aspinall called his brother on May 22 and asked him to go to his partner’s residence and destroy her CCTV equipment, saying “it would revealed 60 or 70 further offences”.

“The next day the defendant told (his partner) it had already been destroyed,” Mr Keast said.

Defence barrister Jordan Ahlstrand said his client has four children aged between four months to 10 years with two women.

He said Aspinall started using marijuana when he was 16 years old and progressed to methamphetamines, but claimed he had not used illicit drugs in the past 13 years.

Mr Ahlstrand said alcohol had been a “precipitating factor” in Aspinall’s previous criminal behaviour.

He said his client had worked at a quarry for five years and then concreting with his father for seven years.

Aspinall pleaded guilty to one count of attempt to pervert the course of justice and three of providing false information to prison officials.

Judge Jeff Clarke sentenced Aspinall to 15 months prison, cumulative on the 12 month prison term from 2023, declared 230 days presentence custody as time served and set parole release for May 15, 2024.
