Michael Patrick Warry applies for bail in Rockhampton Magistrates Court

A man allegedly sent an “incomprehensible” amount of text messages and made about 300 calls to a woman while on bail for an alleged assault, despite there being a no contact condition against the woman.

Michael Patrick Warry, 65, applied for bail in Rockhampton Magistrates Court on April 12.

Mr Warry was charged with one count each of breach of bail condition and unlawful stalking.

Police prosecutor Clancy Fox opposed bail being granted to Mr Warry.

Magistrate Jason Schubert read the facts of the charges to the court, which stated Mr Warry received bail on March 28 following an alleged incident on March 22 where he attended an address and allegedly entered the dwelling of an associate of the alleged victim of the unlawful stalking charge.

Mr Schubert said while at the address, Mr Warry allegedly punched a man and hit him with a metal bar, causing him to suffer a 8cm laceration to the top of his head.

He said Mr Warry was then given bail with one of the conditions that he not contact the female victim.

“He breached that immediately by sending text messages to her,” he said.

He said Mr Warry allegedly sent an “incomprehensible” amount of text messages to the alleged victim.

“There are more than 7500 texts and nearly 300 phone calls,” he said.

“This is in circumstances where the defendant signed a bail undertaking that stated he must not contact or communicate with the female victim of these offences.”

He said the messages included the following:

“Funny how you can go out to dinner with someone else but not f---ing me.

“Answer the question, who the f--- was the c--- who took you to dinner last night please?

“You scared to tell me are you?

“I’m going to find that dog for trying to get on my lady.

“If I come over now there not going to be any men there huh?

“I’m coming over right now to see for myself.”

Mr Fox said Mr Warry told police he was “practically engaged” to the alleged victim.

“When told by police that the victim stated they were not in a relationship and never had been in a relationship, the defendant stated, ‘I don’t care what she thinks’,” he said.

He said a vast majority of the messages and calls were from Mr Warry to the alleged victim.

“There are no conditions that could manage the risk he poses,” he said.

Defence lawyer Samantha Legrady said her client was contesting the charges.

Ms Legrady said she was instructed by her client that he and the alleged victim had been in a relationship.

“She would contact him constantly for money, for food, for cigarettes, also for methamphetamine, marijuana and to take her shopping,” she said.

“I am instructed that with the download of the messages it hasn’t completely shown the messages from her to him or the phone calls from her to him.

“I am instructed she would request money, she would request items and then go silent on him and then he would message her.”

She said her client would not be contacting the alleged victim again.

“He says he wants nothing to do with her after this,” she said.

“He says he feels she had just used him for his money and to do things for her.”

She said, if granted bail, her client would reside in Frenchville, report to North Rockhampton police and would comply with a tracking device, curfew and no mobile phone.

Mr Schubert refused to grant Mr Warry bail, stating he had shown “utter contempt” for his bail conditions.

“The defendant has no regard whatsoever for bail conditions,” he said.

“If I released him on bail he would commit further offences, interfere with the witness and I can’t give him any bail conditions to mitigate that risk.”

Mr Warry was remanded in custody with his matters adjourned to June 1.

Briefs of evidence were ordered for the unlawful stalking charge, as well as enter dwelling with intent and assault occasioning bodily harm charges.
