Max Bohen denied bail after charged supply drugs, possess drugs

A magistrate has questioned whether a drug addict in his 40s on numerous drugs charges can be relied upon to return to court if released on bail.

An unemployed man accused of supplying drugs while on bail for other drug offences claimed he wanted to attend drug rehabilitation services while living with his parents in a Central Queensland mining town, a court heard.

Max Bohen, 42, appeared in Rockhampton Magistrates Court on June 18 charged with three counts of supplying a dangerous drug and one of possessing more than two grams of a schedule one drug.

He was also charged with possessing anything used in a crime, possessing tainted property, offence to buy or possess S4 or S8 medicines or hazardous poisons, possess drug utensils, breach of bail, fail to wear helmet while riding a motorbike and light vehicle must not be driven or parked on a road if defective.

The offences allegedly took place between June 10 and June 16 in Allenstown and The Range.

During a bail application, defence lawyer Samantha Legrady said Mr Bohen wanted to be bailed to his parents’ residence in Emerald so he was away from Rockhampton and he now has a referral to a rehabilitation service.

She said he was willing to report to police five days a week and comply with a curfew.

Ms Legrady said he did not have any drug type offending or fail to appear in court convictions on his one-page criminal record, but did have a fail to appear conviction.

Police prosecutor Claudia Neill-Ballantine said while Mr Bohen did not have a lengthy criminal history, these were quite serious charges and the breach of bail was quite recent.

Magistrate Cameron Press said Mr Bohen was on bail at the time of these alleged offences for other alleged drug offences and unlawful possession of weapons.

“There would also seem to be a suggestion that he may have a drug issue,” he said.

“That is, he is addicted to drugs.

“If he is addicted to drugs it would seem incongruous that he can submit that he will just stop using drugs now.

“I think there is a real likelihood that this defendant if granted bail will continue to commit further offences.”

Mr Press remanded Mr Bohen in custody.

Briefs of evidence were ordered for the serious charges and all charges were adjourned to July 2.
